Protecting the Dignity of Individuals on the Autism Spectrum in the Light of Legal and Ethical Frameworks

Abstract

The concept of human dignity lies at the core of both legal and ethical systems. This article explores how the dignity of individuals on the autism spectrum is recognized, protected, and potentially compromised within international, European, and Polish legal frameworks. The paper begins with a philosophical and legal overview of the notion of dignity, tracing its evolution and its enshrinement in key human rights documents. It then focuses on the specific challenges faced by autistic individuals in realizing their dignity, particularly in relation to autonomy, inclusion, and social recognition. Special attention is given to the Convention on the Rights of Persons with Disabilities (CRPD), as well as subsequent EU and Polish legislation that aim to implement its principles. By analyzing selected legal instruments and their application, the article highlights the progress made, the existing gaps, and the need for further systemic change to ensure the full participation and protection of individuals on the autism spectrum. The study ultimately emphasizes that the protection of dignity must be proactive, inclusive, and grounded in both law and ethical commitment.
